What will I be charged with? Am I going to Jail?

2 nights ago I got pulled over because of speeding. The cop asked for my i.d. and I had my friends license (my license is suspended) so I gave that to him and it turned out hers was suspended as well but this would have been her 3rd time getting caught with suspended license. So all he asked was for me to call someone to get my car and he let me go home. The next day I called and told them what happened, that I gave them the wrong i.d. but the officer who pulled me over hasnt called me back yet. I have a court date but it's all under my friend's name. I am going to tell them my identity and everything, and I did call the day after admitting what happened. Will I be going to jail for false i.d.???

  1. You probably will not go to jail, but there are so many factors in your situation that no one can really predict what will happen to you. It all depends on what the laws are in your state regarding false ID's and driving on suspended licenses, as well as your age and criminal history. Considering your license was suspended I imagine there are probably a few violations on your driving record, which I'm sure a judge will take into account, as well as the fact that you were speeding and driving when you weren't allowed. The worst penalty you would probably face is a very big fine, and maybe even a couple hours of community service. It's also likely that you could lose your license for awhile. If you're under 18, the chance is incredibly small that you'd have to do any jail time.

    However, also take into account that in most states using another person's ID as your own, is also a misdemeanor with it's own set of penalties, and that your friend, can also get in trouble for giving her ID to you. Just issues to keep in mind when in front of a judge or the cops. They might want to punish your friend too if they're really hard core.

    I would recommend that you really try and fix this whole mistaken Identity thing before you even have to go to court. Go down to the police station in person and explain again what happened, cause the harder you try to get everything straightend out, the more the judge will take notice of your effort. He/she will probably cut you more slack than if you just waited till the last minute on a super busy day in traffic court.

    It is okay to drive on a suspended license and give false information to the police.

    It is fine to drive and say,"to h**l" with the law, the courts, I am driving baby!

    Next time, go all out, get drunk and drive to!

    However you will not be considered an evil criminal genius, and you might even get sympathy for being born stupid.

  10. There is no way to know that positively. What is your criminal history like? You might get away with receiving a citation for obstruction or could be charged with criminal obstruction. Depends on many factors. The fact that you called and admitted to what you did will help you as long as it was done because you felt guilty about it and not because they were hot on your trail and were going to catch you in that lie. Always tell the truth, didnt your mother teach you that?

  11. Well....Considering that you posed as a whole different person, and that she was on her third strike...and that you didnt have your own license....I would say that there is a pretty good chance something big will happen...like jail...

  12. No They will only charge you with not having your D.L. present at the time of infraction (which can be reduced with an attorney), a DWS, plus the speeding . Just dont make it out to sound like you were trying to be dishonest. It was an accident leave it at that and take your fine and possible 5 days or so depending on your states laws. No harm no foul.

    That was a very bad thing to do to use your friend's ID which was suspended instead of yours, which was suspended.

    Check up on false ID laws in your state, consequences vary widely. I wouldn't count on jail time though, there will be a fine and your license will be revoked.

  14. probably 10 days in jail for showing an officer false identification. you should have just admitted that you did not have your license and faced up to the consequences of your actions.

    it is never alright to lie to anybody, especiall yanyone in law enforcement, there are stiff penalties for lying to an officer, it's called perjury.

    Speeding, and a false license?  - Ok You'll be fined around a thousand dollars, but NO, I highly doubt that you will be put in jail.
