  1. The judge stops the trial and confers with the lawyers. They go over exactly how and why this alleged jury tampering occurred.

If he thinks he needs to, the judge will speak to each juror separately, in chambers. The court recorder will also be present, and usually the lawyers.

After he questions the jurors and finds out exactly what happened, the Judge and the lawyers will decide what needs to be done to continue. Perhaps the trial can continue if one or two jurors are replaced. If need be, the judge will declare a mistrial, they'll draw a new jury, and the trial will begin again.

The jurors may just be dismissed, especially if the tampering were minor and accidental. ("I'm sorry, judge, I turned on the TV to find out who won the ball game and they were talking about the trail.") or if the tampering were intentional, someone could be charged.

  2. Just remember this, it is a crime to influence a jury to make decision in your favour by illegal means other then a fair trial process involving presentation of evidence and court proceedings. It includes discussing the case out of the court, offering bribes, warning of dire consequences or asking a friend or family to make negotiations with a jury member.

    People will go to jail.

    Another trial will follow.

  3. Jury tampering is the crime of unduly attempting to influence the composition and/or decisions of a jury during the course of a trial.

Most likely, the judge will hear motions for mistrial from both the prosecutor and the defendant's attorney and then render his decision.

  4. Being Lawyers, they will try to find out who and how much money is involved and try to get their cut.

    Whats wrong with America, Lawyers.

  5. To the jury member or the defendant?
