my green card was confiscated when i was about to renew my greeen card because i overstayed outside US. my green card was acquired through family base. while it is confiscated can i petition a fiancee or marry and petition spouse?

It sounds like you have lost your green card privileges.  No, you are not abl to petition a fiancee.

If your permanent resident status has been terminated, you cannot petition for anyone.

Lawful permanent residents cannot petition for a fiance in any case.

Lawful permanent residents can petition for their spouses.

If you signed a form I-407, you are no longer a LPR. If you were served with a Notice to Appear before an Immigration Judge, your case is still pending.

You are no longer a permanent resident of the US.  You will need to talk to a lawyer asap re your status - if you were given an I-94 on entry, you are a tourist and will have to leave the US.

You cannot sponsor anyone for admission to the US.

I'm not sure what you mean.

Do you mean that your legal form of ID was confiscated because you overstayed your allowed length of stay in a foreign country?

Or do you mean that you stayed outside of the US for too long and US authorities now consider your green card to no longer be valid?

If 1), contact the US embassy in whichever country you're currently in

If 2) then you can still contact the US embassy but I think you might be in trouble.

If and when you have a valid green card, you may petition for your spouse and unmarried children under the age of 21 to join you in the US.
