Okay. I am trying to get my husband his residency. We've been together for 2 years and have a son. I already submitted the application and received a letter through the mail. I had to print out the I-864 Affidavit of Support under section 213A of the Act..I dont make enough money to be his only sponsor. We see that we can use his income but we have to send copys of our w2s and income tax. I just want to know if anyone out there knows what will happen if we send in his income tax and w2s and they will see he used a fake ss#. My husband is 21 and I am 20. His father was the one that gave him the fake SS# when he was little.

  1. With any luck, he will be deported.

  2. conspiracy to commit fraud... with any luck he will be deported with no criminal charges brought against him

  3. It doesn't matter who gave him the number. If he knowingly used a fake SS# he has committed fraud. Just because you make up a bunch of numbers does not mean that number does not belong to someone, somewhere in the US. If it does in fact belong to someone,it is identity theft.

If he filed income taxes with a fake number he also committed tax fraud.

I'd say when immigration finds out,he will be ineligible for any type of legalization.

  4. Have him get a tax identification number. That way all his earnings will be properly reported under the TIN #. Anyone in the tax business can help get this number and convert his old SS# earnings to this new number which is legal. He will not be deported as the other responses have said, but any debt and prior activity will show up when you file as his spouse and he gets a real social security number. The TIN # is the best way to show you are trying to follow the system as they want you to show that taxes have been paid and are current.

It sounds like they need to take all other earnings with that SS # and get it transferred to the TIN #. Have you tried that? They  all you are using when filing this paperwork is the TIN #.

  5. He committed some crimes here. He did  fraud and identity theft . So odds are he will likely be deported as fraud and identity theft as becoming big crimes for citizens of the United States.

  6. Nothing will happen to him.  he just needs to let the social security administration know that he hadn't any knowledge until recently that what he thought was a real ss number was really a number given to him by a relative when he was a baby.  He must say he is coming forward in good faith that they can help him remedy the error.

  7. fraud and identity theft of someone.... I vote for deportation~!  It seems identity theft has become a real problem in the US, but many in here seem to think it is ok for an illegal to commit this crime.
