Question:

What will happen to someone for falsifying a police report in regards to domestic abuse in CA?

Someone I'm associated with called 911 on a friend of mine and stated to the police that he slammed her head into the wall, when she was the one that did it to herself. If we can get her to recant her story and tell the truth what will happen to her? Will she go to jail or be fined? She just had their baby who is 3 weeks old. Will CPS take their child away?

  1. The answer to all of those is maybe.

    False reporting is a crime in most jurisdictions, penalties can vary according to severity and impact.

    CPS could come in.  Based on your statement, she is a danger to herself, therefore, by extension she would be a danger to her child.

I hate people like her some nasty chick did that to my husband (prior to us getting married) and it really makes like hard-even though he was found not guilty, there was still a charge I hope she goes to jail...she is a real piece of c rap and a real worthless person...she can go rot in jail...she is probably ugly too- tell her to get right and what comes around goes around...she is an awful person and I hope she gets screwed! Girls like her make it hard for real women!

  3. She can be charged with falsifying a police report. I don't know about them taking the child away because they could just give the child to the father if he is fit.

  4. Be very careful about trying to get someone to "recant her story."  It is a felony and is called witness intimidation.  See CA Penal Code 136.1

    If you witnessed the alleged incident that did not occur, let the police, prosecutor and defense attorney know.

    If the alleged abuse is ongoing, CPS will step in.

  7. I doubt anything will happen. Proving a report is false is difficult, and it is very common for abused women to recant their story at a later time. Because of this, most states will continue to pursue charges even if the victim refuses to cooperate. If there is a lack of evidence, it may be dropped.

    As far as CPS taking the child, that is unlikely if this was a single incident. They will not get involved unless there is a danger to the child.
