What will happen when Ace cash express files a case to get their money back from a pay day loan in Texas?

I took out a pay day loan 3 months ago. I now owe them 283.00 dollars. They called me to inform that I could no longer make payments and that they wanted me to pay the amount in full by 5 pm that same day. If not they said that they were going to file a case against me. I need to know if they can really do this and if its going to be a civil matter or not. I am not worried about my credit but I am worried about any criminal charges.They also told me that that they were going to verify if i was employed and that they were going to speak to my human resource department. I then told them that i was unemployed. Please someone help me with an answer.

  1. check with your attorney general, these places have been deemed illegal in most states, and are being sued for violating interest rate laws, they may owe you money, check on line and see what ohio and pa did to these places


  2. You will not go to jail.  It will be a civil case and not a criminal one.  The rotten thing will be that they will win the case and you will have collection agencies hounding you to pay up the money for quite awhile.  They will also tack on penalties and fees.  Of course, they might not actually take you to court over $283.  Kind of a drastic thing for them to do for such a small amount.  Also, in Texas, they cannot garnish your wages which is nice.
