What will happened if I take belongings that belong to tenant out of fridge but its my fridge?

What will happened if I take out all the stuff that belongs to my tenant? Its my fridge and I don't want her c**p in there. She put a restraining order on us. But the commissioner lifted the 100 yards. But she leaving on September 6th. I don't want her to use my washer and dryer and my fridge. What will happened if I take it out? What if she calls the police what will they do? Any advice. Thanks

  1. Is it really worth the hassle?

    As explained elsewhere,  if use of the fridge etc was a part of the agreement you cant just change the agreement.  

    Its tragic that the relationship lowered to the point of restraining orders.

    You should have seen tensions rising log before that and so dealt with it then.  

    I think the best thing you can do now is button your lips and let it pass.

    The last thing you need now is her filing a claim for damaged goods (food) taken from the fridge or clothing that was left damp and is now rotten because you took them from the dryer.

Well, things differ from state to state but here in Mass the laws generally tilt towards the tenants.  Here in Mass if they were entitled to use something when they rented the place the they are entitled to use it until they surrender the apartment/home.  Sometimes being a landlord really sucks, eh?

  3. If she is still legally under the contract she signed to rent the place, excluding any amenities that were in your original agreement would be a breach on contract on your part.

    At this point just let her use the appliances for a little bit longer, you don't want to risk escalating the argument further.

    If you are worried she may damage them, take plenty of pictures as well as noting the condition of them.
