My boyfriend went to go see his probation officer this morning and he has been smoking marijuana. I know he's stupid I told him not to. Well, he hasn't returned home yet and I'm pretty sure he isn't returning home (in jail). This is his 2nd time coming out dirty. He is on probation for Burgulary Inhabitation. How long do you think he will sit in jail? Will they most likely give him the full 2 years just for smoking marijuana?

  1. He's busted.  Hopefully, he'll be off the streets and locked up for 2 years.  You like this guy?  I hope you aren't planning on waiting around for him til he gets out.  He'll be someone's b**** in jail.  What wonderful tales to tell your children.

  2. Here's the best answer:

    Leave him!! <3

And yeah, if they didn't come down on him the first time, you can be pretty sure they're going to get him the second time.

  3. They very well could (and should) revoke his probation. If he has two years remaining from his previous charge, yes he could spend all two of those years behind bars.

  4. Could very well be that he will do the 2 years.

  5. Not for smoking.....but they will give him 2yrs for violating probation.

  6. He out smoking more pot, if he comes home stoned. 10 this way.

  7. It depends how his sentencing was written. Most of the time probation is given as a lesser charge for a prime. Upon violating probation, the person normally has to serve out what the original sentence should have been.

He will be able to leave as soon as he is bailed out and will not serve that sentence until he is convicted in a courtroom.
