What will moving back to Mexico do to my husband's green card?

We have been married 15 years and he has had a green card for 12 years. We are both on disability and are having a hard time financially. If I apply for FM3 status in Mexico, what will that do to my husband's green card. Also, we do not want to lose our Medicare as I have some major health problems. We would like to move to a border town to make it easier to come back to the U.S. for medical treatment. What kinds of things do we need to know before we make these changes? Thank you, anyone that can help.

  1. Your husband will loose his green card if he moves to Mexico.  You will need to apply for citizenship if he want to not loose it.  Good Luck!


  2. i think ud be risking his green card if you move back but its like a 50-50 chance. =]

  3. There is only one thing to ensure that all works out in the end. Your husband has been in the US long enough so he needs to apply for citizenship.

  4. Why not apply for US citizenship? If your husband's been here for 12 years then he's well past the requirements and can apply for citizenship, which would take care of all issues concerning leaving and re-entering the US.

    Moving to Mexico by itself will not do anything to his green card, however if you plan on being absent from the US for more than a year, then you need to apply for a re-entry permit BEFORE leaving the US so that the validity of the green card will not be revoked after a year.
