What will the judge say if i'm probation and got a dirty drop?

i live in kane county ill. and i've been pretty cool with staying out of trouble until now.

  1. I don't think that's going to do you any good, now.

    You've been behaving yourself, but the choice you made will probably revoke you.

    Talk to your lawyer and your probation officer and see what they have to say.  If this is an isolated incident not related to your original charge, you may have a chance for leniency.

    Just don't moan about the consequences of your actions, just accept it and make sure you don't find yourself in a situation like this again.

  5. Hello Tony. There are a lot of variables here. If you are a first time offender and have kept a decent probation record for a majority of your time, chances are pretty good you will be given outpatient status for drug rehab.

    If your original sentence was a drug abuse charge or if you are a repeat offender, chances are about 50/50 you will be violated.

    If it helps at all, have a serious but polite talk with your PO. His written report will have quite a bit of weight with the Judge when you go to court. If your PO recommends outpatient rehab, chances are VERY good you will get it.

    Just one warning if it helps. If you are given rehab and you test dirty again during your probation, the Judge is more than likely to reinstate your original sentence. Keep it clean after this.
