I'm pregnant, and no longer in a relationship with the father. He has a lengthy criminal record from juvenile to adult. Mostly for assaults ( none on me), and drug dealing. I was wondering if he took me to court for custody or visitation what would the courts rule? I have no record and always work full time legit jobs, he never has a job for more than a month. And please no comments on the fact that I chose a bad father for my child, the pregnancy wasn't planned and you don't know all the facts just stick to the question please and thank you.

  1. The likelihood that the father would be granted full or partial custody of the dependant child is slim, especially in this case where he has a lengthy criminal record displaying arrests for assult and drug possession / trafficking, and since there is no job stability.

The judge might rule in favour of visitations, but considering the criminal record you could easily appeal to have supervised visitation only, limited to a few hours a week.

    Best of luck!

  2. He might get supervised visitation, but not custody.

  3. I wouldn't worry about custody.  BUT he has every right to visitation.  So just expect him to be allowed visitation with his son/daughter.  But he will also be court ordered child support etc.

Honestly no one can say exactly what a judge will rule except the judge but visitation is going to be normal to expect.  It'll be up to him as a father to visit his son/daughter and provide child support to assist with the up bringing.

    Don't stress it............

  4. he wouldn't get custody unless you also have a record that is worse i would appeal if the judge gave my child to a convicted drug dealer
