What would be the legal consequences of shooting someone with a paintball gun?

Some people are motocrossing thru my property. I have asked them to stop. I have contacted the police. If I "shot" them with paintballs and they took legal action, what could I face?

  2. They could have you arrested for assault. Maybe try a fence? Or place boulders at their acces point to block them? Something so it isn't a fun place to ride anymore. :)

    Also, you should place 'No Trespassing' signs prominently where they could see them. Then if they still come around, you may have some legal recourse.

  4. My knowledge of this particular situation is minute, but if it was happening to me,  filing a complaint with the Police and the Parents can be a strong deterrent to their activity. If not satisfied with this,  contact a few Attorneys to get advice (all attorneys aren't great).                     Good Luck and God Bless

  7. Likely assault - you have no legal right to shoot someone with a paintball merely for driving through your property. Erect no trespassing signs and/or a fence if you don't want them there.

  8. When I was a senior in HS this kid in my class shot another kid from his neighbor with a paintball gun. The kid had been throwing stuff at their house. Well he ended up getting charged with assault and battery, aggravated assault, and child abuse b/c he was 18 and the kid he shot was 14. He ended up having to pay for a lawyer, paying the kids medical bills (he shot him at close range and the kid didn't have a shirt on so it tore his back all up) and was on probation for a couple of years. SO I wouldn't do it if I were you. Just keep calling the cops every time they are out and have them handle it.

  9. you could be charged with aggravated assult , and end up in court and paying for medical bills as well as other fines..  If you put no tresspassing signs up and they still go on your property then you can charge them with tresspassing.

    It also depends on the police as you would be shooting at someone who is unarmed, and could face jail time.  If the person ends up in the hospital bill your looking at medical bills you may end up paying.

    I would try and get them on tape and that way if you did end up in court you have some proof , that they are violating the no tresspassing signs.  also then you could force the police to take action.
