What would be the nationality of a child born in an embassy?

Let's say a pregnant woman in America goes to the Japanese Embassy and unexpectedly gives birth there...Will the child be a Japanese citizen since Embassies are considered extensions of other countries' territories?

  1. Citizenship is determined by the constitution of each country. In some countries (such as USA), citizenship is acquired by birth while in others (such as Saudi Arabia and Ethiopia) that is not the case if the child is born to a foriegn national. Also some constitutions consider their embassies as their ligitimate territories while for others its just an immune building. The US constitution dectates that a child of US citizen is also US citizen at birth regardless of where he was born.


  2. In your example, the child will still be American ONLY. Granting the premise that the embassy is an extention of a country in foreign soil, Jus Solis, IS NOT recognized in Japan.

    Even if the American woman gave birth in Japan, the child still would not be given Japanese citizenship.

    It depends entirely on the recognition of Jus Solis by the host country. It is about time the US reconsider granting US citizenship via Jus Solis.**

  4. It would be the same as is she gave birth in Japan. Since she is American, her baby would be American. In most countries if you're born there you're not automatically a citizen.

    My dad was born while his mom was on vacation in Germany, but he was born an American citizen anyway.
