The law varies on this issue I know, but if anyone can help me out by giving examples of actual cases that would be excellent.

Also, say the girl is fully consentual to the point that she initiates the kiss, but the teacher didn't fight back and fights for the teacher's inocence and insists that nothing else happened. Would that matter at all in a court room?

No, I am not 16 nor am I thinking of coming on to a teacher. I just would like to know what the law would to do a male teacher in this situation. I asked this question last night and I think it got deleted and I have no idea why.

Anyway, hopefully this time I can get some answers.

  1. He would lose his job, his teaching certificate, and be charged criminally.  Not necessarily with child molestation, there was no sexual contact initiated by the teacher so that's not too likely.  They may charge him with it but I can't imagine they'd get a conviction.  Most likely the jury would find him guilty of child endangerment and corrupting the morals of a minor.  Also, yes he would most likely face jail time.  The people who I worked with at CPS who were charged with those things in most cases got at least 1-2 years and a few years probation after that.  But every case is different, so he might not necessarily go to jail.

  2. He would loose his or her job and be charged with contributing to the delinquency of a minor or worse. Pending how involved the parents of the girl got involved with the pursuit of justice.

  3. There's a very good chance that the teacher would be suspended and then fired.  An arrest is also likely.

  4. If it was a female teacher she would get an award.

  5. The teacher should expect to be fired and possible charged with molesting the student.
