Whats going to happen to somebody that was arrested and charged with domestic battery? it's his first offense.?

my friends husband was arrested for domestic battery today, he kicked her and pushed her. she told the police this, and he was honest about what he did. now he has to stay in jail until the 6th, when he has a misdeminor hearing. what is going to happen to him? this is his first offense, he has never been in trouble with the law before. is it worth bailing him out or will he just be sentenced back to prison on the 6th?

  1. In the State of California, Domestic Violence is taken very seriously and the victim no longer needs to press charges in order to have the suspect arrested. If the officer has probable cause to make the arrest, then they will be arrested and taken to jail for a felony charge. The bail amount is $50,000.00. Pretty steep. The victim will also be notified once the suspect has been released.

    As far as your friends husband, he could bail out and just go to court in 72 hours. If he has been arrested before for the same crime, he may be looking at some county jail time which is for less than 1 year sentence. Unless you want to pay to have him out early...no need to bail him out. Plus, let him learn his lesson.


  2. I would say that he will be charged and given a fine. He might even have a restaining order placed on him and not allowed to go near her.A lot depends on wheather his  wife files a report on him and wants him charged. I dont think he will be given a jail sentence unless he has a History of violence. A stay in jail would probably do him good.

  3. Chances are its bogus.  85% of women who claim "abuse" are simply lying.

    if guilty he probably will take a plea bargain to avoid more serious things,

    if not guilty nothing.

  5. He will probably get out on probation. She needs to hide and live in a shelter or with friends he has never met. She needs to  leave and hide for the rest of her life!
