i knocked my elbow at work on a scaffold peg that wasnt coverd (6 mnth ago) and now every time i knock it it REALLY hurts.

i just filled in a accident claim form and it said i could be awarded up to £6000 but whats the procedeur? will i need to go for tests etc lawyers/courts?

i didnt log the accident in the accident book at the time as i regarded it very minor will that effect anything?

  1. holy cow that is a LOT of money!!!!!!!!

I don't know the procedure but Had to say holy moley!

  2. Go and see an accident specialist lawyer, you may be in for a disappointment but take proper advice

  3. Yers.. with no record  your claim might be difficult

  4. If you didn't put it in the accident book, you haven't got a snowball in h**l's chance!

Don't start paying for any tests, reports, etc - you will NOT get anything out of this.

  5. If you did not report this to your supervisor or log it in the accident book, then you will have a very difficult time proving this alleged injury is work related.  The purpose of workers comp is to compensate an injured person for medical expenses, lost wages and rehab if needed.  It is not intended as a source of monetary compensation unless you have a permanency, scarring, loss of function etc.  You need to seek medical attention to begin with, and the doctor has to causally relate the injury to the incident.  Doubt he/she will do that since six months have gone by.
