i was charged for license being suspended 4 months ago for not showing up to a behind the wheel test at the DMV. i was charged also with an open container, i was not drunk passed all tests. no previous tickets AT ALL.on my ticket it says its a MISDOMEANER!! i live in california. what should i tell the judge?? i really hope i dont get my license suspended like my friend told me until im 21!! i work i goto college great guy HELP!

  1. Go get a lawyer.  seriously.

    California has a zero tolerance policy for drunk driving; if you're under 21, then ANY BAC above 0 is illegal, regardless of if you're able to pass all field sobriety checks.  However, seeing as you weren't taken into custody then, it seems the officer was reasonably convinced that you weren't drinking and driving, which works in your favor...

    But you really aren't doing yourself any favors by acting irresponsibly, so depending on the judge, you can get the maximum sentence, to "teach you a lesson".  So, again, go talk to some lawyers; most offer free initial consultations which will give you a lot more direction for minimizing your legal obligation.  Try looking for a lawyer through www.legalmatch.com instead of just looking up random ones in the phone book.

    BTW, no, it's not the end of the world.  Even if you get your license suspended, you can still get around.  It's just going to be REALLY inconvenient, but will hopefully help you in the future by reminding you to be a responsible driver.

Driving on a suspended license is a serious offense, and can result in further suspension.  Having an open container is a serious offense, and can result in license suspension for a person under 21.  You need a lawyer for these charges.  If you cannot afford an attorney, one will be appointed to represent you.  There are sometimes ways to avoid the more serious consequences of offenses such as these, but you are not going to be able to handle this case alone.  Tell the judge you want a lawyer.


  3. Before you go before the judge, enroll in an alcohol program for drinking problems and enroll in drivers ed. Your going to have to show the judge that you are serious about your charges if you want him or her to cut you a break.

  4. Always plead "NOT GUILTY", never plead guilty.  He should give you a court date after that.  Usually your court date will be within a month.  Like I said, plead not guilty, always.  You can always say that you collect cans to sell, for extra money.  Hope you didn't have any full cans your vehicle.  Anyway, you will probably get a small fine if the judge doesn't believe you, but a lot of people collect cans for extra money.  Hopefully, you will get off scot free.  If you ever have open cans in your car and you save them, try to put them in your trunk or throw them out immediately.  Always keep them in some kind of bag, also.

  5. Kiss it goodbye. There are consequences for your actions. Now you must live with them. Get a bus pass!
