Whoever has power of attorney or the executor of the estate, whichever one is handling the finances at the moment, would be the one contesting the charge.  Contesting a fraudulent charge on the card is really not a lot different than paying the credit card bill--and the bank that issues the card certainly expects the deceased person's estate to do *that* even though he/she is dead.

  3. It would be contested by someone else who has their name on the card, maybe a spouse, or whoever is handling the estate.
