use as a result of the injury, how do they figure the amount if....

you had previously planned a vacation before the accident. Your employment record shows the time used as vacation, but you really used it to recover. How should they figure that?

  1. I'm assuming you're referring to an automobile accident where another insurance company is going to settle your injury claim. If you had to use your vacation time to recover, the company should reimburse you your base salary for that amount of time. If you work strictly on commission, they'll need to see your tax return for the previous year to get an average for that amount of time. You should NOT have to lose your vacation time because of someone else's negligence. Also, keep up with the mileage to and from the doctor and physical therapy visits as these are also recoverable expenses. Good Luck!


  2. I've never heard of insurance covering personal time off.

    If you were injured on the job, and were getting Workman's comp, you never should have let them use your vacation and personal time as recovery time.

    If you weren't injured on the job, well, I don't know what kind of insurance you had, so the best thing to do would be to call your company.

    Good luck, I'd be interested to hear if you insurance company pays off.
