  1. You're always guilty till proven innocent. Otherwise, you would not be questioned for hours, held against your will, go to trials, need an attorney etc...

    I do not often disagree with the law, but with the "innocent until proven guilty" nonsense yes, I highly disagree....

  7. Generally, you are innocent until proven guilty.

    However, there are exceptions. In the even you are claiming self defense, that is an "affirmative defense". That means it is up to you to prove you had the right to use it.

    Other affirmative defenses are insanity, and necessity. Necessity means you had to commit the crime to prevent a greater evil. For example, if your car breaks down in sub freezing temperatures, and you break into a house to prevent yourself from freezing to death, you will not be charged with breaking and entering.
