When baby is born and i file for child support and full custody

im due dec.31st. im not with the babys daddy. i will be talking to a lawyer about getting child support and full custody. so far, my ex wants nothing to do with the baby. if i get child support and full custody will i need to let him have visitation? what if he shows up one day asking to take the baby for visitation? will he need to ask the court for visitation or does he just get it bc hes the dad. i live in ny. please only answer if youre certain.

  1. Child support=visitation unless he has a history of abuse or if he signs away his parental rights, but if he signs away his rights you don't get the money the child deserves. I think it's sad when a father would ratherhave nothing to do with their baby. Is this really true or do you want to have your cake and eat it too? Only you know the answer to that.


  2. CHILD SUPPORT DOES NOT MEAN VISITATION ...I live in FL and my ex did not want visitation when we divorced however he still had to pay child support... if he wants to see the child then he has to ask the court and he still has to pay you child support... however it takes a while

The lawyer would be the best source for information on NY laws, but as a general rule visitation in support orders is described as "reasonable".  It is not reasonable for someone who has never set eyes on a child to show up without calling ahead and just expect to pack a baby up and wander off somewhere with them so you could say no to that and still be considered reasonable.

    At this point, there isn't any 'baby' for your ex to have anything to do with, there's just you, the pregnant ex, and if this pregnancy was unplanned, I'm sure you can see why he's not enthusiastic.  Things may change when the baby's born and he get to meet him or her as a separate person from you.  Try very hard to be a good enough Mom to allow him to create a bond and have visitation because if at all possible it is much better for the child to have a relationship with his/her father and the father's relatives.  It also makes it much easier to collect support when he can see that his money is being used to provide for the child's needs.

  4. You cannot have it both ways. If you ask for child support your ex has every right to visit his child.  Good luck getting suport too..  Your ex will probably claim that the child is not his.  It may be a while before you receive any support.

If you have full custody and he is paying child support then he likely will still have parental rights.  Unless those are terminated he will have the right to visitation with the child but this is arranged through legal processes.  Unless his parental rights are willingly surrendered by him or are taken away (usually due to unfit behaviors) he is entitled to visit his child if he chooses.  Asking a parent to give up their parental rights usually means no child support.
