the car is turning into a alley sorry i did not mention that and i have stop to look to my left because my house is on the corner lot he had to have hit me

Are You serious?  The person driving on the street has the right of way (everytime) over a person just backing out of their driveway.  If You got hit; it's entirely your fault (sorry).

Where I live, (Alberta Canada), whenever you enter a roadway from a driveway, parking lot or back lane (alley), you must stop before entering that roadway. This is to allow you to see what is coming along the roadway and to give them right of way. You also have to observe conditions in every direction and you should also back out of a driveway only to your right (where I live, backing out onto a roadway to the left is considered illegal). If you live on a corner lot, then you have to take precautions to ensure that you don't hit anyone or get hit yourself........

USE CAUTION............Check your local Highway Traffic Laws too....make yourself aware of the laws regarding driving a vehicle on the road so that you KNOW your laws and drive within them.After all, it is your responsibility as a driver.........and I appreciate you asking this question in this forum, but it is also a better idea to check with your state laws, don't you think? The laws protect the public, and are there to use in a court of law......IF necessary......
