When did IDEA ( individual disabilities educational act) become state law?

  1. IDEA was originally enacted by Congress in 1975 and was then called The Education for All Handicapped Children Act (EAHCA). It has been revised many times and in 1990 was renamed the Individuals with Disabilities Education Act (IDEA). The latest revision was published in August of 2006.

The name 'IDEA' was introduced in 1990 to replace the name of a previously inacted bill.  IDEA 2004 was signed in December, but didn't go into effect until the next summer.  Well, each state had to adopt the law, so this date likely varies from state to state, you don't say what state you're in, so I can't answer.    It's taken my state a very long time to catch up, in fact the final revision of our special education law bringing it in line with IDEA 2004 will go into effect this summer, if we're lucky!  Government moves very slowly...

  4. Federal Law outweights state law unless the state law is more powerful then the federal law which is extremely rare. The state has to implement the law by the date given by the federal government. Your state can enact the law early for example, New Jersey required effective September 5, 2006. The federal government expected October 13, 2006.
