When do you get charged tax on fast food in California?

When I go to a fast food restaurant, like Subway Subs, sometimes I get charged tax, and sometimes I don't. What is the difference in the order that triggers the tax?

That's a question you should ask the local subway or the local city/town/etc government.  Reason I say this is that every state has different laws regarding taxes.  I would be charged 2 different tax rates depending on where I got the food.  From my understanding, taxes are paid on any prepared foods, but again, could be different for your state/city/town.  I've never lived in a state that didn't charge taxes for any prepared (fast food, even food from deli in super market).  The best thing to do is to ask them, if you find the local number for the subway you eat at, call them and ask, this way you'll remain anonymous.

  4. I am not a tax expert, but in my location they charge tax on Fast Food only when the food is consumed on their property.  For carry-out and drive-Thru orders, no taxes are charged.

    There are some communities in California that started to charge a "litter tax" at Fast Food and Convenience Stores.  The revenue from the tax was to cover the cost of cleanup.

  6. At subway  they charge tax on toasted subs and not on untoasted.  I have no idea why, as both are made to order. The only difference is one is prepared using electricity.

  8. any food that is prepared is taxed, prepared food thats in wrapper (BAG) not taxed! federal law!
