  1. On my property, the forklift has the right of way. So does the Back hoe, the Bobcat, the crane, the manlift and the excavator.

    Under most normal circumstances, the pedestrian would have the right of way, and the driver woudl have to stop.

  4. LEGALLY , the bloody Employer Verified/Authorised Bi-Pedal Speed-Bump...(pedestrian)...!

    OH&S Legislation (written by Moron`s , who don`t ever get out into the `Real World`) state that the fork-lift (and its Operator) must be constantly Aware of the Presence of these annoying work interruptive anomolies and that the Operator MUST "give-way".

    pity that these Clowns don`t realise that LOADS on the tines of the Fork-lift DON`T have the Capacity to `see` the Speed-bumps and re-act (accordingly) to the Legislation of the OH&S Authoritarians....!

    Simply , ALL Regulations should put the Onus BACK on the Speed-bump , to make THEM protect them-selves from their OWN Stupidity.

  6. I would say it depends. If the pedestrian is walking around the loading dock, then they should be aware of the moving objects around them.

    I have a FL license.

    Around a garden shop, the pedestrian would have the ROW. Around the loading dock, you would. They have no business being there.

  8. always the pedestrian... that said...  you should look out for forklifts as they MAY NOT SEE YOU!!!

  9. Pedestrians always have the right of way to a forklift. I have a OSHA issued license and the thing they hammered into our heads is if anyone is within 3 feet of the lift you must come to a complete stop, put the lift in neutral and either hold the brake or engage the parking brake. Hope this helps
