When entering a parking lot and intersection in the lot, from the street,does that car have to yield ?

My son was driving in a parking lot and was a little more than half way through the intersection when a car turned in from the street and darted in front of him (right to left) There was a yellow line that the guy drove through My son hit him. Was the yellow line a yield sign? It seems like he would have to yield.

  1. Sounds like the whole thing happened on private property. The only tickets that could be issued are careless and reckless driving the lines on the lot don't mean anything. Parking lots are bad news. IF it comes down to finding fault then it would depend on who was occupying the area first.


  2. No, your son does not have to yield half-way through an intersection.

    You give your statement to your insurance company.

    Then you call his insurance company and tell them you wish to make a claim.

    The insurance companies will decide amoungst themselves how to handle it.

    In a parking lot, nobody has a "right of way".

    People forget that "right of way" is a funny concept -- it can be yielded, but never taken.

  3. From what you are describing I would say that this was not your sons fault.....
