My fiancee had her visa interview yesterday and they granted it to her and her first son, but our baby together while waiting on the visa they said she needs to get is U.S. citizenship. i have the forms but i'm not certain about best way to get dna, i've found some local labs online that say they work with immigration cases, and can test me here in U.S. and the baby there in Philippines. but what should i be aware of, also i plan to have notarized copies of my passport and birth certificate as proof of my citizenship, and proof of our time together during conception. and proof of her pregnancy. what other things can i do to insure a speedy acceptance and issuance of his U.S. citizenship status and then is U.S. passport so that he may travel with my fiancee and her son?

  1. As you already know, being a child's "legal" father is not useful for citizenship or immigration.  You need to prove that you are your baby's biological father.

Did the consular section request a DNA check?  If so, they can advise you on how what process they accept; some consular sections have confidence in certain labs but will not accept results from others that are iffy-er.  Also ask them directly what they want you to send to support your paternity claim for your child.  If they did not want to issue a visa to the baby, that makes it pretty clear that they believe you are the father.  They will tell you what they need to help you make your case.

  2. if your name is on the certificate you are legally the father in the us

  3. Maybe you could bribe some officials?

  4. Doghorsemom is a consular officer at a US embassy in Europe.  She's an expert.

In the Philippines the US Consulate should be able to provide you with the names and addresses of labs they trust for DNA evidence.  Believe me, it's a common problem over there.
