When i get child support does he get visitation whenever he wants? does he need to take me to court for it?

how do we figure out visitation? is that another hearing or when i ask for child support we figure it out? NEW YORK

  1. No. Child support and Visitation are SEPARATE. Many women and men make a HUGE mistake in this area. You cannot deny the other parent visitation, whether or not they have paid child support. You cannot deny paying child support even if you are not allowed to have visitation. The judge will decide these issues separately, keeping in mind the child's best interest. Usually it happens all at one hearing, but it could be split up if there are complications. You should discuss this with your attorney.


  2. my brother had to fight tooth & nail to see his daughter, his ex hardly ever turned up at an agreed meeting place.she ended up facing prison,

    & he gets to see his daughter only,he cant call himself dad for another month.the rest of the family have not seen her for nearly three years.  unless there is mental or physical abuse dont fight to stop any contact.

    Having said all that, what's best for the child(ren) is what really counts. That should be your motive. Would visitation be beneficial for the kids? If so, do the right thing and put your pride aside. If he's a danger to the kids fight him tooth and nail.
