When in small claims court.?

would citing case law in small claims court have any advantage to case or because it is small claims, no advantage?

  1. When the amount you are disputing does not exceed a certain amount, depending on what state you live in. It is quick and you don't need a lawyer. You only pay a small amount of filing fee.


  2. Don't appear in court and cite a case.  File a point and authorities with the court citing any cases and statutes you would like the court to consider... then at the hearing you can refer to the cases.

  3. Well if you need to cite in order to prove your case then it would be to your advantage, esp. if the law clerk or judge is not famliar with the citation.  Lawyers and judges have so much to remember they would welcome learning about it.  But be careful because judges really hate case laws that are not applicable to the case or mis interpreted-- some judges will chew you up and spit you out like day-old gum.
