When is a company allowed to rehire a permanent position when an employee is on disability?

If an employee is on short term disability when does it go to long term? When is a company legally allowed to rehire for that position?

Unless there's a contract stating otherwise, there's no restriction on how soon the employer can fill the position.  

Short term disability is usually under six months.
