Question:

When is an offer with a company legally binding?

The company just completed my reference checks today - sounds like everything went okay. I am really excited about this opportunity and hope that they follow through on their promise and make me an offer. How long does it usually take to get the offer after reference checks? Also, when is an offer legally binding? I wont be able to start for another week and I don't want them to be able to withdrawl an offer if something like a hiring freeze goes into effect. Is it the start date or the actual acceptance of an offer that makes it a contract?

  1. Unless you are a contract employee, job offers are never legally binding and you more than likely will sign a piece of paper stating so. In 10 years of my career I have never had a contract. (A contract employee would be one that is specifically hired to complete a certain project within a year or two). If this is just a normal job or career...then nope, not legally binding. They can hire you and fire you before you even start...Sorry.
