When is it a breech of contract?

My husband reenlisted a year ago with the stipulation that he is reclassed. He was given a school date for sept 12 but found out yesterday that he is not slotted for that class or any. We thought everything was a go since he has orders to report to a unit for the new job in January. So my question is how long does the Army have to send him to school before it becomes a breech of contract?

  1. Read the rest of the contract.  There is a clause in there about "good of the service" which is their out for doing what they want.    


  2. the best way for you to find out is ask a military lawyer. That way they can look over the contract and see what it really says

  3. I will take he did not get in writing on his reenlistment contract so if he didn't its not a breech

  4. if he has it in writing, upon the next slot available.

    contact the recrutier and have him call the retention nco

    if a no go, contact IG.

    as for breach - not enough, deployed or deploying troop get priority.
