When is the best time to file an eviction notice?

If a leasee is already 2 weeks late in paying his/her rent, should I file an eviction notice immediately or should I give this person at least a few more days out of good faith?

  1. Depends on where the home is and the laws for that state so laws may differ in your state.  Generally, rent is not considered late until 9 days after the due date.  After the 9 days, you sometimes have to send them a written notice giving them 5 days to pay.  Then you serve them with a a Notice to Quit and then you serve them with an Eviction Notice.

  2. File immediately. You always have the right to hold off on actually evicting them if you choose to give them a few more days to get the rent paid.

    If you don't file, and then they don't pay, then you have to file and wait out the required notice periods.

  3. I'd file as soon as possible.  If they're 2 weeks late now, can you imagine what will happen in the future?

  4. depends on the person ...can you trust them?....have they done it before?...if it was me i would just serve it to them face 2 face ...your not a charity.....

    The next best time would be one week and five days ago.

    If the renter resolves the matter satisfactorily before the eviction deadline, you can withdraw it.

    Tolerating late payments or other violations of the conditions of contract will only lead to further and to other violations.
