Question:

When on probation in state of Pennsylvania if you get pulled over driving w/o license is that a violation?

I don't have a license right now, but i need to drive, if i was to get pulled over for driving without a license would they violate my probation and would i do jail time or would it just be considered a moving violation? Thanks for your responses.

  1. Driving while on a suspended license can get your probation violated.  I would suggest you rethink the issue.  You say you need to drive, but actually that need is just a "want" to make your life more convenient.  If you get revoked, you will still have the suspended license as well as more legal problems for driving w/o license.  Add to that all that you stand to lose while you are locked up.  Doing time is easy compared to all you face when you get out and realize that you have lost all while you were locked up.   God's Blessings to you and yours.

Derek from Philly:  As you are from or near the Philadelphia area, mass transportation and SEPTA are options you should use.  If you get stopped while driving on a suspended or restricted license, not only will you get more points to further delay your ability to get a fully restored Drivers License, but also you will now have a misdemeanor charge which can result in jail time and real probation.

It is a violation because while on probation you are not to commit any new local, state, or federal crimes.  Driving without a license (DWOL) is not a moving violation like speeding.  In most states it is a petty misdemeanor or misdemeanor offense.  To ease your mind though, I've never heard of someone's probation being revoked just for DWOL.  There's a difference between committing a probation violation and being revoked.  A violation is just a singled mistake that can be dealt with just a verbal reprimand by your PO or some more intensive sanction like community service.  Being revoked involves either many individual violations or a single very serious violation and can result in you being resentenced to jail/prison.  My advice is to avoid DWOL just to be safe.  Don't create a hassle for your PO.

  4. As the first person said, driving w/o a license is against the law. Why do you not have one? If you have to drive to work you might be able to get a special license to drive only to work and straight back home.

  5. I am not from PA but driving without a license is against the law anywhere.  I would be surprised if I am wrong.  While on probation you can not violate any law.

    Get a bicycle or take public transportation.  Do not get into trouble.
