Question:

When someone gets served with court paperwork.....?

doesnt that person have to sign a document and doesnt that document get filed away? (the doc. with the signature on it) A bailiff is saying that she doesnt remember if a person she served signed and that she cant find the paperwork. Is this possible? How does this work anyway?

  1. No the person does not have to sign for it and the person does not have to accept the papers either. The person that is delivering the papers can after identifying and making contact can drop the papers on the ground if the person does not accept the papers. Sounds like the bailiff was not doing a very good job.


  2. It depends on the jurisdiction that you live or been served in. The best way to get this answer is to contact the clerk of the court for that judicial district .

  3. Usually, the officer signs that he served the paperwork to the person, paperwork sometimes get filed in the wrong place, that happens once in a while

No...they don't have to sign the paperwork, otherwise people would just refuse to sign.  But the paperwork has to be served by someone in an official capacity - like a marshall - the marshall then fills out an affidavit swearing that he/she served it, to who, when, and usually a physical description.  If someone is never at home or refuses to come to the door, they can also do what's called a "nail and mail", where they leave the paperwork at the person's legal address and also mail them a copy.

  5. the bailiff needs to be more alert with her job if you have to go to Court just let the judge know what happen at least you did show up for your hearing and that should work in your favor                    good luck

  6. If someone is served with paperwork sometimes they don't have to sign for it & the person who delivered it will testify in court that it was personally served.
