Question:

When the placement on an IEP says 12:1, does the 1 have to be a spec. ed. teacher or can it be an assistant?

This placement is in a "special class integrated" setting, which is really inclusion without writing inclusion on the IEP. Also, if it is revelant this is in New York State. The 12:1 setting is supposed to be for 5 hours daily.

  1. The ''1'' does not have to be a special education teacher in the integrated setting. It would be an additional assistant. It will not be a special education teacher. The portion not included in the five hours is probably recess and lunch (also breakfast, if it occurs during the instructional day for special education students).

    Ideally, according to Best Practices, if you asked a professor, the student would eventually not have an assistant and use independent learning strategies. Possible consultation from the resource teacher might be used.

It is supposed to be a teacher, if they were talking about assistants, there would be an additional number, like 12:2:1, where 12 is the student number, 2 is the assistant number and 1 being the teacher. Under IDEA and NCLB, there must be a highly qualified teacher in charge of all students, especially special ed.

  3. I don't know what 12:1 means , but If it is not a SPED  teacher then it has to be an assistant working under a SPED teacher. IEP has a section where you can see what areas you need the help and for how long .

  4. !2:1 typically refers to adult to child ratio. The 1 does not have to be a teacher but there better be a teacher if the situation is really like 24:2.. one of those 2 better be a teacher. There really is a over use and over reliance on instructional aides. Aides can deliver lessons, supervise students etc. But they should not be writing lesson plans or designing instruction.

  5. If it is NOT written into the IEP plan, then it is NOT legally inclusion.

    If you agree to inclusion, you need to make sure this is written into the IEP plan or the school can change this and you can't do a thing about it.

    If they refuse, ask for prior written notice of their refusal to do this. They have to have legal reasons for their decisions and give these reasons to you in writing in this notice.

    YOu can also tell them to write whether the '1'  IS a special ed teacher or assistant in the IEP plan. They are suppose to do this anyway.

    Since this is not written into the IEP plan, they can do anything they want. Heck, the  '1'  can be a janitor as long as it's not specified in the IEP who '1' is suppose to be.

    And they want it to be this way so they can use whoever THEY want and you can't do a thing about it.

    But if you have WHO IS 1   in the IEP plan, then you CAN do something about it if they don't use this specific person.

  6. Has to be a certified teacher.
