  1. Statistically in the USA, The American League of Bicyclists and  the American Automotive Association agree overwhelmingly it is the car driver at fault legally.

Why is that?  The Car driver almost always said that they did not "SEE" the cyclist in the police report.

Even very good drivers, and drivers that ride bicycles often, some times do not see bicycles.

  2. Depends. Either could have turned a sharp corner, in that case both are probably at fault. If the car ran a light or sign then its the cars fault. If the cyclist suddenly crosss the road, is going to slow, or is out of his land it is his fault.

  3. duh

  4. Hard to answer that with out much detail as to who was doing what and who hit who?

  5. Most likely, the car

The same question can go for a pedestrian and a car

  6. Driver

  7. The driver because socially the bicyclist is seen as defenseless and he is also favored because he is not polluting.

  8. it depends like if the bicyclist had the green light and the car

blew though the red light who do think would at fault here?

the car driver would be for running the red

but if the bicyclist ran the red and got hit then the bicyclist would be at fault

    (it depends on the situation)

or sometimes the car driver may not see the cyclist (if that

cylist is in the drivers blind spot)
