  1. Whoever caused the accident.  It doesn't matter whether it's the motorcycle or the pedestrian.


  2. The pedestrian has the right of way in the USA, but not in all other countries. Check the law for that country.

  4. If your in california the pedestrian always has the right of way, but i couldnt know how it is anywhere else

  5. You will probably find that no matter what the vehicle is, they will always be at fault, not the pedestiran.

    The pedestrian does NOT always have the right of way.

    It just seems that way, as the driver has the obligation to avoid any accident.
