It isnt that easy to answer. Reasonable suspicion is needed for an arrest, but all the facts and data go to the Prosecutor's Office, where the DA goes over everything.

What a DA looks for is how strong a case is. No DA wants to waste the taxpayer's money on a weak case that he stands a decent chance of losing. Kind of like a poker hand. If you have a strong hand, you stay in the game. If the hand is weak, you fold.

Once all the data is compiled, if the DA feels he can win the case, he presents his evidence to the Grand Jury for an indictment. If the 25 people of the Grand Jury feel that a crime has been committed and it appears that the person involved was responsible, they return an indictment.

The person is now formally indicted and a date is set for court.

As a prime example of justice working slowly, look at the Jon Bonet Ramsey case. No indictments were ever returned to this day.
