When will it be legal for me to work in the United States again?

I am a registered s*x offender, and because it shows up on background checks, I can not work for any business that does background checks. I am a United States citizen.

Many of you might see this as justified. I have two convictions, one for indecent exposure (2000), one for sexual assault (2001). The second was for touching a clothed woman for one second on the upper part or her left breast; think of how much worse Arnold Schwarzenegger has done. He paid someone off to keep from getting a conviction.

I have worked in temporary positions for 3 major banks after both convictions; one of them nine times. I have also worked for other major corporations, yet permanent work is elusive.

I have since lost my home and two weeks ago applied for welfare. I have never before had public assistance of any kind. I received $465 immediately in food stamps and will next week get cash and medical. The medical will come in handy since I have a Pterygium in my right eye; it costs $3,000 to treat but will most likely be 100% paid for. My eldest son will soon receive a free University of California edcation since I have little income; he starts school next month.

My house was foreclosed and the same banks which will not hire me will have to eat $60,000 in credit card debt.

The cost to the government is litterally just beginning.

I am very ambitius and am currenty involve in many charitble causes.

Because of the nature of the crimes I am not on any public database; there are no restrictions on where I can live or who I am be with; children included.

I have no issue with needing to register, but the fact that even after I had these records expunged; cleared by the courts, it still shows on background checks.

I do not need anyone to give me their self-righteous views. Just think of the things the police and miltary get aways with on a regular basis; the wealthy also.

Any suggestions on how to get by this obstacle? I have considered moving to Canada. I have visited there 3 times in the past. There are no retrictions on where I can travel.

I forgot to mention that I have been to group and individual counseling. I have learned from my mistakes, can I just move on and work again? I do not want public assistance of any kind.

  1. I think there is a way to fight what is on your record. There should be a phone number for the company that was used to do the check, call them. My suggestion would be to figure out what your strengths are and start your own business. If you what it bad enough you can do it with no money. You could also be an independent contractor.  You also need to be in prayer daily to see where God wants you.


  2. If you have these charges expunged from your record it is illegal for anyone to have these on your record. Expunged mean removed completely and fully from every record you have.

  3. Are you sure these records have been expunged, which means these criminal files have been destroyed? Did some on-line agency tell you this information was expunged or did you receive something in writing from a state board or panel?

    If, in fact, these files have been expunged, then you need to contact the agency that is dispensing this information. You need to show proof of the expungement and then file for a non-disclosure of the files.

    It wouldn't hurt to contact a lawyer concerning sealing and/or expungement laws for your state. It could take several months and possibly a year or two to be cleared in some data bases. Also, ask a lawyer about the penalties for background check agencies that continue to leak this information after it has been expunged or sealed.
