  1. When you are on private property all bets are off.  Nobody is at fault (no fault insurance).  That is why the speed limit is 5 - 15 mph.  Statistically most accidents happen in parking lots when backing out.  That's why it is safer to back into your slot and pull out in one fluid motion.


  2. the pedestrian always has the right of way as long as they are walking in the legal "path." In a parking lot I would think that would be the pedestrian's right of way.

  3. My Dad had an old saying about this. "Once someone gets into an accident and kills someone, they can never say they are sorry."

    The speed limit is 15 mph in a parking lot, not 45 mph like a crazy mad person would do or 3 mph when someone blocks traffic.

  4. The madman just stay out of his way so you don't get hit yeah it sucks but walking the extra 10 or even 100 feet is not that big a deal when the alternative is getting hit

    The general rule of thumb (where I live anyway) is the vehicles traveling across the lot (perpendicular to the aisles) are given the right of way over cars waiting to turn out of the aisles.

    Pedestrians, no matter what, ALWAYS have the right of way. Don't ever race across parking lots, especially near the store front where most of the pedestrian traffic is. Getting a hard tap from a moving car is NOT a fun thing. The tap itself is very painful and so is the pavement when the pedestrian falls on it. I know because I've been "tapped" once. I was halfway across when some idiot comes racing up, slows down to a stop, but decides to tap me with his car instead of letting me cross.

  7. If you are a pedestrian, you have the right of way. But you are probably asking about two cars; one parked and one moving. I believe the moving one has the right of way.

  12. Your goal when driving is to avoid accidents and incidents, not to enforce the traffic rules. If someone is driving recklessly you ought to get out of their way. Driving is not a contest, it is a mutual agreement of cooperation among everyone on the road.

  13. It's probably your turn, but try to go "your turn" and BAM you'll get in an accident cause the madman will hit your car.  I hate people like that.
