When you file bankruptcy and a mortgage is in the list can the mortgage co, still file foreclosure after?

the bankruptcy is over? even when they did not respond to the bankruptcy lawyer.

  1. If you have secured debt, and you do not reaffirm (agree to pay) such loans securing the debt during Chapter 7 bankruptcy, you lose the collateral securing the debt (ie, your home).  Likewise for vehicles or any other secured debt.

    You cannot expect to get out of your home loan AND keep your home.  And you cannot expect to get title for a vehicle if you do not pay for it, even if it is not worth it to them to repo it.  That's life in the real world.


  2. brenie....this all depends...you don't give much information....Did you file a chapter 7?? a chapter 13??? Was the mortgage included and you re-affirmed on the loan? If you re-affirmed on the loan and haven't made the payments, yes, they can foreclose. Not sure what exactly your question is...you can email if you'd like.
