When your contract expires with a realtor, do they still get 6% if you sell it yourself?

In Maryland if that matters:

I have heard that if the contract expires there is still a waiting period during which if anyone else sells the house, the realtor still gets the 6%? True?

  1. No, not if you have an expired contract. You could resign with another realtor the next day. Check your state laws, it could vary but I don't think so.


  2. Make sure the contract does not have and automatic extension clause.

    If you actually sold before the contract expires but delayed disclosing the sale, you have committed fraud. "Sales" within 30 days after the contract expires are usually suspect.

  3. No.  However, you must read your entire contract with them.  Your state laws could be different.

  4. Usually within a certain period after the listing contact expires if someone the real estate agency showed the property purchases the property then they are owed a commission.

  5. No, that usually only applies to a client they have brought to see the home, so that only makes sense they may still be entitled to their fee. You can terminate your contract at any time if you don't feel they are doing a good job selling your home. Remember they work for you.

  6. Not after it expires, but it is a good idea to be represented when you sell instead of FSBO.  If your buyer has an agent, then you will still have to pay his commission. You can change agents after expiration.  

  7. You do not pay any commisions unless the party you sell it to saw the house while under contract with the realtor.

    If the buyer is new and had never seen the house previously, no commision.
