Question:

When your stimulus check is garnished for child support, do they let the person who is owed the child support?

know that they will be receiving $$?.....My ex owes me about $5000 so far from child support. He filed his taxes this year and that was sent to me. I know I will be receiving his stimulus check, I'm just curious to know when?

  1. i received my ex's refund and is expecting his rebate also,i didn't get a letter to expect his refund and still haven't gotten one yet and that was back in april,i'm not expecting to get a letter about the rebate either,but i'm expecting the rebate and will get it,they can keep the letter,just show me the money.

    go to irs.gov if you know his ss#,it goes by the last 2 digits and view the payment schedule.

  2. go to the irs web site.(irs.gov) there is a scedual there that will tell you what day the check is supposed to be mailed by. You need to know the last 2 numbers of his social...

  4. The IRS will NEVER mail you any money that they offset from his return or stimulus payment directly.  There is a LONG process when they offset (take) a persons tax refund/stimulus for back child support.  

    First the child support office that holds your case MUST tell the IRS that he owes back support, how much, his social, etc.  Then when he files his return his social will be flagged in the IRS system.  Next the IRS will HOLD up to his entire return (depending on what he owes to you), but no more than he owes to you for a mandatory 3 months.  They do this just in case there is an injured spouse or other legal claim filed.  After the 3 month waiting period is up, the IRS will send the amount that they held to the child support office that requested it.  The child support office then has to update their records, & they are allowed to hold it for an additional 120 days if they so choose.  The cs office is not required to hold it that long, but can if they want to.  THEN it gets sent to you like any other normal payment.

    The IRS will NOT give you any information regarding his return, if they are holding it or how much they are holding.  The child support office MIGHT send you a letter saying that they are getting the tax refund, some do some don't.  Some will send a letter saying that they are going to try to get the tax refund.  But ultimately you will not know if you are going to get it unless, one the ex tells you hey they took my money, or two it shows up to you.  Offsetting a tax refund or this stimulus thing takes a LONG time.  Expect it within 3-6 months after he filed his return or 3-6 months after he was supposed to get his stimulus payment.  Like I said the cs office will sometimes release things sooner than 120 days.  And the IRS will sometimes release sooner than the 3 months, but that is completely up to them.
