Recently a friend has rented a home that apparently is foreclosed and owned by a bank. The person who rented her the apartment has nothing to do with the property. He just decided to scam her. What kind of law does this fall under?

  1. .   My friend rented her house to a woman.  That woman "sold" it and took earnest money deposits from buyers who thought she was the owner.

You don't need a private attorney.  The Attorney General prosecutes this.  Make copies of all the paperwork for them. DOn't make them have to copy everything.

  2. That is so crazy, yet it is happening everywhere.  Hiring an Attorney is going to cost you or your friend more than it has already cost you.  Small claims court is your best bet. Now, from now on, look up the property owner before you rent it. It is public information who owes a property.

  3. Just plain fraud.

This is a growing scam, especially hard-hit areas in California, and these are rampant on Craig's List right now.

I am advising EVERYONE that I talk to, to check the title with the courthouse before you rent a property, to make sure a foreclosure hasn't been started on it.

If everyone starts doing that, then it will put  these people out of business.

  4. Your friend needs to contact the District Attorney.   This is fraud, and they are the ones that handle it in CA.

  5. It's fraud.

Just call the cops, and the bank. They will tell her how to report this.

  6. That's going to cost far too much, I'd just tell her to put it in her "life lessons" book and make sure she researches her landlord as much as the landlords research the tenants these days.  Count the deposit and however much rent she paid as payment for her lack of knowledge.  Public records show who owns places, within 1 minute I can find out who owns the house next to me.
