Question:

Where can I find a lawyer that'll go up against a school district or a school administrator like a principal?

My sister has been harassed phys. and emotionally by a group of girls. The administration has done nothing. My parents have talked to the principal, the person who handles these types of situations. Basically we have talked to everyone whom you think could help or could do something about the situation. She cannot learn in an environment like that and whats worse the administration isn't doing a thing about it. Please help me figure out where I could find legal aid. I'm not even sure if legally somehting could be done, but any information would be great. This problem has been going on for at least two years if not more. Please help. Info for the bay area in California would be great. The group of girls has both physically and emotionally harassed her.

  1. Of course "someone" can attempt to sue a school, a school district, or a principal. It happens all the time!

    However, you'd have to find a lawyer who was willing to take your case, assuming he/she thinks you have one.

    There are some online resources to locate lawyers in your area, and sometimes they will only charge a very small fee for a 30 minute session. At least with this, you might get an idea as to whether or not you have any kind of case??

    Just search "free legal information" on Yahoo and look at some of their sites. Good luck!

  3. If you have a case any lawyer that does that kind of work will take the case if the money is right. The rich get privilege while poor get screwed.

Your parents needs to file more complaints with the principal.  They also needs to go to the administration at the school district and have her change schools.  They may need to hire an attorney (don't expect anyone to do it for free).  If they have been physically harassing her, they need to file a complaint with the police for every incident.  

    Keep detailed records of what happens.  What they say, who says it.  Any physical abuse.  Also keep a record of who it was reported to, what date, etc.  That way you can also look at filing criminal charges and have legitimate claims if the administration continues to ignore it.

    Part of the problem may be that there is no real record of the incidents, so it's one word against the other.  You need proof.  Tape recordings, statements from witnesses, record of the events before anyone can really do anything.

  5. Why don't you put a civil suit on the each girl? Call the cops when it happens make a report.  

  6. Assuming your parents have proof of all of this, they could appear before the school board and demand action. It would be even better if they could have an attorney appear before the school board. Most general practitioners can do this.

    but yes you can get a layer on the case because if it is physically and emotionally harassed her and you've been trying to do something about it and they haven't done anything then do something like that

    or move school if that doesnt work  

  9. You cannot do anything to the school legally...you should be going after the girls. If they have hurt her physically why has noone filed a police report>?
