I have been writing in here for over a month now. short brief, this is the case where DA is good friends with a guy I threatened to sue. after exhausting every avenue of trying to get the neighbor to keep his dog from killing my livestock, I finally advised I would take to court. Two days later I was arrested, got an attorney, she tried to make me take a plea for something I didn't do. hired three more attorneys from another larger city and tried to advise them this was small town good old boy stuff, they didn't really believe until they got "I would say jolted in court", the judge basically didnt want to have to fool with this because its a misdemeanor. to me its a criminal record. He set a trial date of November and adv if I moved before then he may think about dismissing the charges. DA's brother lives right beside me and advised me that he heard somewhere I may be selling out and he would be interested in buying my house. of course this came from his brother. is there anywhere i can turn to get some justice? Do these things just get done all the time in small towns and everyone overlooks. I have the DA 's brother on one side and the guy bringing charges against me on the other.I can barely go outside, I am ordered by the court to have no contact and if they decide to say I did, I am in jail again. I have nothing else on my record not even a speeding ticket. could I go to the media on an open case? could I write the judge a letter and let him know whats happening? or is that illegal? some help please.

  1. I would suggest you contact the State Attorney Generals' Office and the "State Bar Association" and file a conflict of interest complaint against the DA and a complaint against the attorney that tried to get you to take a plea and the judge for even suggesting he'd drop the case if you moved. Very unethical. Yes I would contact the media (not the local paper or tv station. Instead I'd contact the media in the closes large city) but I'd talk to the Attorney Generals Office first. This is if you have legally done nothing wrong. If you could get the offer in writing it would help and a copy of the court transcript and the plea offer.

  2. There really isn't a substantial conflict of interest in this matter.  However, you can file a motion to have the DA's office recused if you believe there is a conflict.  It you are successful then the Attorney General's Office will prosecute.

  3. Go to the media they will eat it up and then you will have a support team in your town and most DA's and courts do not like getting negative publicity so they may back off :)
