I need to file for sole custody of my daughter and I don't know what to do? Where do I get this form? And how long does it usually take?

  1. Number one rule......... Get a LAWYER. Let him help you do it all.


  2. If you are receiving child support, you do have to allow the father to visit the child.

    If he is a disruptive influence in your household and especially if he cannot be trusted to be responible when he takes the kid for a visit, then you need to go back to court and ask the visitation to be changed to "supervised visitation only".

    In this, you would drop the kid off at the courthouse and the father would be able to visit the kid in the presence of a court-appointed officer. You wouldn't have to deal with the father, and he wouldn't have the opportunity to misbehave.

  3. It's not just a form, its a court proceeding.  You may need an attorney to help you.  If you can't afford one, perhaps there is a legal aid in your area that can help.  At the hearing, the judge will determine who gets what kind of custody.
