Question:

Where in the Geneva convention does it say it only applies to uniformed military personnel?

I just read the whole thing and this is the only part that even has the word uniform in it...

Article 27

Clothing, underwear and footwear shall be supplied to prisoners of war in sufficient quantities by the Detaining Power, which shall make allowance for the climate of the region where the prisoners are detained. Uniforms of enemy armed forces captured by the Detaining Power should, if suitable for the climate, be made available to clothe prisoners of war.

The regular replacement and repair of the above articles shall be assured by the Detaining Power. In addition, prisoners of war who work shall receive appropriate clothing, wherever the nature of the work demands.

  1. It only applies to the war of standing armies. Thats what it was designed for. Non-military fighters don't follow the rules of the Geneva convetion generally.

    Until the middle of the 19th century all of the treaties concerning war victims' protection were circumstantial and binding only for the signing parties.These agreements were purely military-designed, based on strictly binding mutual obligations; and they were in force only during specific armed conflict.

    The parties to a conflict must at all times distinguish between the civilian population and combatants in order to spare the civilian population and civilian property. Neither the civilian population as whole nor individual civilians may be attacked. Attacks may be made solely against military objectives.

    EDIT - WWII was started in 1939 - Geneva conventions, were accepted on August the 12th, 1949 - so no, it wouldn't apply because it wasn't written yet.
