Where should i apply and how for an appeal against the refusal of a US tourist visa from?

I was denied a US tourist visa without even my documents being examined. it appeared to be a pre-decided affair at the US embassy in New Delhi at the time of the interview. Is there any way i can appeal this refusal on grounds of an unfair decision? Where do i need to go for this? any court or tribunal or if any relative of mine can appeal in US itself?

    Hi my name Tina, I work at a private firm called immigroup. Unfortunately, the officer does not need to give much of a reason to deny you a visitor visa. You are allowed to re-apply for a new visitor visa and show up with a lawyer but I think it would be a waste of time. What you should do is wait 6 months and re-apply again to increase your chances show up with a lawyer and make sure you have strong ties to India ex: proof of land ownership, letters from work stating you're on vacation, and the officer must feel without a reasonable doubt that you will return to the country where you live.

  2. Visa issuance is exempt from an appeal process - the consular officers are highly intelligent, highly trained, and experienced.  They are expected to make the appropriate assessments and apply the laws and regulations properly.

    You are welcome to re-apply, but unless your situation and circumstances change significantly, it is unlikely that you will get a different answer.  The earliest you may re-apply for a visa is three business days after your last interview.

    Q. What is Section 214(b) and what does it mean?

    A. Section 214(b) is part of the U.S. Immigration and Nationality Act (INA). It states:

    every alien … shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for a visa … that he is entitled to a nonimmigrant status

    It means that the burden of proof is on the applicant to show that he or she is not an intending immigrant. The consular officer uses the interview to determine the intentions of the applicant. For more information, click here.
